Receiving a visa refusal or facing deportation can be incredibly frustrating and disheartening. However, all hope is not lost. If your immigration application is denied, the UK immigration system provides an avenue to challenge these decisions. Depending on the type of application that was refused, you might have the right to  appeal the decision. Knowing your rights and the steps involved in lodging an appeal is crucial to ensure your case is presented effectively.

This guide will walk you through the essential steps of the UK immigration appeals process, key factors to keep in mind, and tips on how to approach an appeal with confidence.

How to Appeal an immigration refusal

The first step in any immigration appeal is understanding whether you have the right to appeal the decision made by the Home Office. In general, only specific types of immigration application refusals carry the right of appeal. These typically involve situations where human rights are involved.

Immigration refusals that can be appealed typically involve:

Refusals on Human Rights Grounds, for instance if your application is based on human rights concerns, such as family life or private life under the European Convention on Human Rights (ECHR).In such instances,  you will have the right to appeal.

Asylumor humanitarian protection applications too will carry the right of appeal in most cases,if refused. The Home Office’s refusal to grant asylum could be based on the belief that you do not face persecution in your home country or that your claim does not meet the necessary criteria. The right of appeal will not be affected by the reason of refusal. The only time that the right of appeal will be denied is if the claim is certified, meaning the Home Office considers it clearly unfounded.  

Deportation or Removal Orders too generally carry the right to appeal if you believe the decision is wrong.

It is important to remember that not all visa categories allow for an appeal. For example, refusals of visitor visas, student visas, and skilled worker visas do not have the right of appeal. If you are facing a refusal under one of these categories, you may still be able to challenge the decision through an administrative review rather than a full appeal. In certain situations even a Judicial Review might be suitable. You should always seek legal advice before challenging any refusal, as the complexity surrounding immigration refusal is quite high.

How to appeal Immigration refusal

If you have the right to appeal, you will have to follow a certain process.

The first step is to lodge your appeal. When you receive a refusal decision, the letter or notice from the Home Office will specify if you have the right to appeal and what the deadlines are. It is crucial to act quickly—failure to file within the allowed time frame will result in your appeal being considered out of time,which is likely to lead to dismissal without any further action being taken on it.

If you are in the UK, you generally have 14 days to submit an appeal. If you are outside the UK, the deadline is usually 28 days. In both instances the time runs from when the decision was sent to you. This is why it is important to keep evidence of when you have received the decision.

To lodge an appeal, you must complete an appeal form, this can be done either on a paper form or online. The online version is recommended, as it ensures you do not miss any directions from the court. All immigration refusal appeals start at First Tier Tribunal for Immigration. This is where your appeal form should be sent, if done on a paper form.

The form will ask you your personal details, the details in respect of the decision and also the grounds on which you are appealing. These will depend on the type of application that has been refused and the refusal reasons. You will also be asked if you wish to have a hearing or get a decision based on papers presented. In most cases hearing should be requested,as this gives you the best chance to present your case.

You will need to pay the appeal fee before it can be considered lodged.

The process then will proceed with directions from the Tribunal for the Home Office to present its bundle of evidence. Following this, you, as the Appellant, will be given time to present your evidence and arguments. After this is done, the Home Office will be asked to review the case in light of your arguments and evidence and reconsider its decision.

How to win your immigration appeal

As mentioned above, part of the process is for you to present your case. This involves preparing your bundle of evidence and putting together your legal arguments showing why the Home Office decision is wrong. Therefore, gathering supporting evidence is critical to the success of your appeal. Do not wait until the Tribunal issues directions to provide your evidence before you start preparing your case.

What kind of evidence you will need to provide will largely depend on the type of application you have and the refusal reasons. For instance, if it is a spouse visa refusal based on failure to meet financial requirements, there is little point in preparing evidence that shows how strong your relationship is. You will rather need to address how you meet the financial requirements, or if you do not meet it, but have compassionate reasons, then evidence to show those compelling reasons.

In all cases, however, witness statements play a crucial role and these need to be prepared with care and attention to detail.This is your chance to put forward your side of things.

Other evidence to consider is expert reports and evidence coming from independent sources, such as reports from states and international organisations about certain aspects related to your case. For instance, if you are applying as an adult dependent relative who needs care, such reports may show lack of available care in your home country.

Apart from evidence, you will also be required to provide your arguments, known as Appellant’s Skeleton Arguments. These will need to include specific information about your case, such as what it is that you are disputing and why the Tribunal should accept your view and allow your appeal.

Once your evidence and arguments have been submitted, the Tribunal will direct the Home Office to review the case on the basis of the evidence and the arguments submitted. This is an important stage, as if your evidence is strong enough, the Home Office may reconsider your application without the need to go for a hearing.

If the Home Office maintains their decision, the next step will be the hearing, where an independent tribunal will hear your case.

While you have the right to represent yourself at the hearing, it is highly advisable to seek professional legal representation. Immigration law can be highly complex, and having a solicitor or barrister who understands the nuances of the system will greatly increase your chances of success.

On the day of the hearing, you’ll be given the opportunity to present your arguments, explain why the refusal was incorrect, and respond to questions from the judge or panel. If you have a representative, they will be handling the presentation of your case.

In most cases, the judge will also want to hear you give evidence. This means you and any other witnesses you have, will be asked to stand as witness and answer questions from the Judge, the Home office representative and your own representative.

The Home Office representative will also present their arguments and evidence supporting the refusal.

After hearing both sides, the tribunal judge will decide whether the appeal should be allowed or dismissed. This decision can take a few days or even weeks, depending on the complexity of the case.
