Rakhi and her team will advise you on the procedure for applying for a Residence Order.  In most cases, you will need to attend a Mediation Information and Assessment Meeting (MIAM) to see if mediation can assist you in resolving the dispute with your partner.  We will assist you with this process and help you build a robust case for why your child should live with you.

You will not need to attend a MIAM if your relationship with your ex-partner has been scarred by domestic abuse, English is not your first language, or you have a disability which would make mediation inappropriate.

The judge will look at many factors when deciding whether to make a Residence Order, including (but not limited to):

  • The wishes of your child
  • How the change of living arrangements will affect your child
  • Your ability to take care of your child
